1. Acceptance of Terms
By downloading, installing, or using FlowFocus ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Tappect ("we", "us", or "our") regarding your use of FlowFocus.
2. Description of Service
FlowFocus is a productivity application that provides:
- Pomodoro timer functionality with customizable intervals
- Task management and tracking
- Productivity statistics and analytics
- Home screen widgets and Live Activities (iOS)
- Optional cloud synchronization across devices
- Calendar integration capabilities
- App blocking during focus sessions (where supported)
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. User Accounts
3.1 Account Creation
Some features of FlowFocus may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the app settings.
4. Subscriptions and Payments
4.1 Free and Premium Features
FlowFocus offers both free features and premium features available through subscription or one-time purchase. The specific features available to free and premium users may change over time.
4.2 Subscription Terms
- Subscriptions are billed in advance on a recurring basis (monthly or annually)
- Payment is processed through the App Store or Google Play
- Subscriptions automatically renew unless cancelled before the renewal date
- You can manage your subscription through your device's app store settings
4.3 Refunds
Refunds are handled by Apple or Google according to their respective policies. We do not process refunds directly. If you have billing issues, please contact Apple Support or Google Play Support.
4.4 Price Changes
We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period after the change. Your continued use after a price change constitutes acceptance of the new price.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the App's systems or other users' accounts
- Interfere with or disrupt the App's servers or networks
- Reverse engineer, decompile, or disassemble the App
- Copy, modify, or distribute the App without authorization
- Use automated systems or software to access the App without our permission
- Transmit any viruses, malware, or harmful code
- Impersonate any person or entity
- Collect or harvest user data without consent
6. Intellectual Property
6.1 Our Rights
The App, including its design, features, content, and functionality, is owned by Tappect and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our permission.
6.2 Your Rights
You retain ownership of any data you input into the App (tasks, notes, etc.). By using the App, you grant us a limited license to use this data to provide and improve our services.
6.3 Feedback
Any feedback, suggestions, or ideas you provide about the App may be used by us without obligation to you.
7. Third-Party Services
The App may integrate with third-party services (such as Google Calendar, Apple Calendar, and authentication providers). Your use of these services is subject to their respective terms of service and privacy policies.
We are not responsible for the availability, accuracy, or content of third-party services. Your interactions with third-party services are solely between you and the third party.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- Any defects will be corrected
- The App will meet your requirements
- The results obtained from using the App will be accurate or reliable
FlowFocus is a productivity tool. We make no guarantees about productivity improvements or outcomes from using the App.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPPECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Service interruption or computer damage
- Cost of substitute services
- Any damages arising from your use of the App
In no event shall our total liability exceed the amount you paid us in the twelve (12) months prior to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Tappect and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.
11. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of these Terms
- Notify you through the App or via email
- Provide a reasonable period to review changes before they take effect
Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:
- Breach of these Terms
- Conduct that we believe is harmful to other users or the App
- Request by law enforcement or government agencies
- Discontinuation of the App
Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination will survive.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tappect regarding the App.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
